NEVER CONSENT TO A BLOOD TEST!!!

Getting arrested in South Texas is THE WORST place in Texas to be arrested for DWI.  Good people suspected of DWI may have to face mandatory blood draws with little consideration for the proper requriements of a search warrant or with no consideration for sanitary conditions.  Many police departments are allowing the cop that busts you draw your blood.  Many of these cops have never had the proper training to draw your blood.  I'm shocked that a lot of them have only had first aid training!!!  This is yet another example of DWI Hysteria!  The Dog will attack the blood test and expose these totalitarian tactics by the parasite cops!

The Intoxi-"Loser" 5000 

DWI law is science.  Breath testing is extremely complex!  Understanding how the body ingests alcohol and how the intoxilyzer machine works will hopefully help your understanding of why you should never blow into this machine.  This article is intended to explain these complex theories in a way that most people will be able to understand.

THE PROCEDURE

When you're suspected of DWI you'll be arrested and brought to the police station.  The first stop is booking, then the intoxilyzer room.  At this point, the cop will read a form what's called the DIC-24.  This form tells you that you have two options - either blow into the machine and if your BAC is over .08 you'll receive a driver's license suspension for 90 days, or if you refuse to blow into the machine and recieve a 180 day suspension. If you have a previous DWI conviction, the suspension periods are much longer. If you possess a CDL, you will lose your CDL for one year.

The Standardized Field Sobriety Tests (S.F.S.T.) 

The one thing to remember is the cop is never going to ask you out of your vehicle to admire your shoes!!!!  If the cop has alreadyasked you how much you've had to drink tonight, and then asks you to get out of the car, chances are pretty good that he wants to "see if you're okay to drive".  Officers are people too, so, they think that "DRINK, DRIVE, GO TO JAIL" is the law.  For many officers, the arrest decision has been made at this point.  Since the decision to arrest has already been made, the SFSTs to these cops is nothing more than an effort to obtain evidence against you.  The Standardized Field Sobriety Tests are typically the third phase in a DWI investigation.  THESE TESTS ATTEMPT TO JUDGE THE USE OF NORMAL MENTAL AND PHYSICAL FACULTIES USING ABNORMAL MENTAL AND PHYSICAL TEST!!!  ALWAYS REFUSE TO TAKE THESE AGILITY EXERCISES!!!  In short, these excercises are designed for you to fail.  Many people can't do these exercises with absolutely  no alcohol in their system. By submitting to and performing these tests, you do nothing but dig your own grave.
